Andrew Epstein was a guest on the CBC Nightly News to provide legal commentary on the BC Supreme Court decision in School District No. 68 v. Carson Dean.
Carson’s Parents were found liable for $48,000 in damages arising from his prank gone wrong.
In this case, the parents have strict liability for the child’s actions. The law says that it doesn’t matter if the damage was intentionally caused or not, and it doesn’t matter if the parents even knew what was happening.
