Andrew N. Epstein was invited to speak at the Canadian Transportation Lawyers Association annual general meeting and conference on October 1-3, 2015 in Kelowna, BC. Andrew reviewed recent developments in Canadian transportation law, including the City of Vancouver/CP Rail dispute.
Andrew provided an overview of anti-blockade injunctions in the context of Red Chris Development Company Ltd. v. Quock, 2014 BCSC 2399. This included discussion of standing in the context of the assertion of aboriginal collective rights as well as potential torts associated with blockades. Next up Andrew provided an in depth review of the highly contentious twists and turns of the Arbutus Corridor dispute between the City of Vancouver and CP, comparing it to the negotiated resolution process that resulted in the Kelowna Pacific Railway corridor being purchased by a consortium of government stake-holders and transitioned into park land.
